Agent Platform and Data Use Agreement

1. Professional authority and accurate information

You represent that you are a licensed insurance professional, maintain the licenses, appointments, registrations, and carrier authority required for your activities and territories, and will promptly update TopInsure if that authority changes. Profile, licensing, carrier, availability, quote, coverage, premium, discount, and policy information you submit must be accurate and complete to the best of your knowledge.

2. TopInsure's role

TopInsure is a technology platform. It does not itself sell, solicit, negotiate, bind, or underwrite insurance. You, your agency, and the applicable carrier remain responsible for insurance advice, recommendations, communications, quotes, applications, underwriting submissions, binding, servicing, and legal compliance.

3. Permitted use of consumer information

You may access and use consumer information received through TopInsure only as reasonably necessary to:

• Evaluate and respond to the specific insurance request assigned or made available to you.
• Prepare, verify, explain, and present insurance quotes requested by the consumer.
• Communicate with the consumer about that request using methods the consumer authorized.
• Assist with purchasing, binding, and servicing a policy the consumer selects from that request.
• Maintain records or make disclosures required by applicable insurance, privacy, tax, fraud-prevention, or other law.

4. Prohibited uses

Unless the consumer gives separate express consent or applicable law requires the activity, you may not:

• Use consumer information for unrelated advertising, marketing, cross-selling, lead generation, or solicitation of products or services unrelated to the request.
• Sell, rent, license, trade, redistribute, or otherwise disclose consumer information to another person or business.
• Build unrelated consumer profiles, enrich unrelated databases, or use the information to train or evaluate artificial-intelligence or machine-learning models.
• Use consumer information for a personal purpose or for the benefit of an unauthorized person.
• Copy, download, export, print, or retain consumer information beyond what is reasonably necessary for a permitted use.

5. Authorized personnel and service providers

You must restrict consumer information to personnel who need it for a permitted use and ensure that they are bound by confidentiality, privacy, and security duties at least as protective as this Agreement. You may provide information to a carrier, agency system, or service provider only when reasonably necessary for the applicable request or selected policy and when appropriate safeguards and contractual protections are in place. You remain responsible for their handling of information to the extent permitted by law.

6. Security and incident reporting

You must maintain reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information, protect account credentials, use secure systems and transmission methods, and follow TopInsure security requirements. You must promptly notify TopInsure at info@topinsure.ai of suspected loss, unauthorized access, disclosure, misuse, or security compromise involving TopInsure consumer information and cooperate with investigation, containment, notice, and remediation.

7. Retention and deletion

You must securely delete or render inaccessible TopInsure consumer information when it is no longer reasonably needed for a permitted use. Information retained to satisfy a legal or regulatory recordkeeping requirement must remain protected, may not be used for another purpose, and must be deleted when the applicable requirement ends, subject to documented legal holds.

8. Consumer communications

You may contact consumers only about the applicable request or a policy they select and only through channels and for purposes the consumer authorized. You must comply with applicable insurance, privacy, telemarketing, text-message, anti-spam, do-not-call, and recordkeeping laws and promptly honor applicable opt-out requests.

9. Monitoring and enforcement

TopInsure may investigate suspected misuse, require reasonable information demonstrating compliance, restrict access, suspend or terminate an account, notify affected parties or authorities when legally required, and pursue other remedies available under the Terms of Use or law. These obligations survive completion of a request, termination of an assignment, account closure, and termination of this Agreement for as long as you possess or control consumer information.

10. Relationship to other terms

This Agreement supplements the Terms of Use and Privacy Policy. If this Agreement imposes a more protective requirement for consumer information, that requirement controls for agents and agencies. Questions may be sent to info@topinsure.ai.
